These Terms of Service ("Terms") govern your access to and use of ListingAI ("ListingAI," "we," "us," or "our"), a software platform that helps real estate professionals generate AI-powered listing descriptions, social media posts, and email templates. ListingAI is operated by KS Ventures LLC.
By creating an account or using the service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.
You must be at least 18 years old to use ListingAI. By creating an account, you confirm you meet this requirement and that your use of the service complies with all applicable laws in your jurisdiction.

ListingAI uses artificial intelligence (Anthropic's Claude API) to generate property listing descriptions, social media content, and email templates based on the property details you provide. The service also provides listing history, team management features for brokerages, shareable listing pages, and brochure generation.
AI-generated content is produced automatically and may contain errors, inaccuracies, omissions, or statements that do not accurately reflect the property. You are solely responsible for reviewing, editing, verifying, and approving all AI-generated content before it is published, distributed, or used in any marketing materials. ListingAI does not guarantee the accuracy, completeness, or fitness of generated content for any particular purpose.
AI-generated descriptions about neighborhoods, schools, crime statistics, walkability, and local amenities are based on the AI model's training data and may be outdated or inaccurate. You must independently verify any factual claims before publication.
Real estate advertising is subject to federal, state, and local regulations, including fair housing laws, truth-in-advertising requirements, and licensing regulations. You are solely responsible for ensuring that any listing content you publish — including content generated by ListingAI — complies with all applicable laws and regulations, including but not limited to the Fair Housing Act (United States), the Equality Act (United Kingdom), and equivalent laws in other jurisdictions.
You agree not to use ListingAI to:
You retain ownership of the property details and information you submit to ListingAI. You grant us a limited license to use that information solely to operate the service (e.g., generating listings, saving your history).
The AI-generated listing descriptions, social posts, and email templates produced for you are yours to use. We do not claim ownership over generated content. You may use, edit, publish, and distribute it as you see fit, subject to compliance with applicable law.
ListingAI's software, design, trademarks, and underlying technology remain the exclusive property of KS Ventures LLC / ListingAI. Nothing in these Terms grants you any rights to our intellectual property beyond the limited right to use the service as described.
If you use ListingAI as an administrator of a business account, you are responsible for ensuring that all team members you invite comply with these Terms. You represent that you have the authority to bind your brokerage or business to these Terms.
Invitation emails sent through the platform are delivered via Amazon SES on your behalf. You are responsible for ensuring you have authorization to contact the recipients you invite.
The Share feature creates a public webpage accessible to anyone with the link. By using this feature, you consent to making the listing description and your agent contact information (name, brokerage, phone, email) publicly accessible. You can delete a shared listing at any time, which will remove the public page. We are not responsible for any copies or caches of shared content made by third parties before deletion.
ListingAI is currently offered without a subscription fee during its early access period. We reserve the right to introduce paid plans in the future. If we do, we will provide advance notice and you will not be charged without your affirmative consent.
You may stop using ListingAI at any time. To request deletion of your account and data, email us at kyle@realestatelisting.ai.
We reserve the right to suspend or terminate your access to the service at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or illegal activity, or if continuation of service would expose us or others to legal or reputational harm.
Upon termination, your right to use the service ceases immediately. Sections of these Terms that by their nature should survive termination will continue to apply.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any AI-generated content.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LISTINGAI AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless ListingAI and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) any content you submit, generate, publish, or share through the service; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.
ListingAI integrates with third-party services including Anthropic (AI generation) and Amazon Web Services (infrastructure). Your use of the service involves data being processed by these third parties under their own terms and privacy policies. We are not responsible for the practices or content of third-party services.
ListingAI is operated from the United States. If you access the service from outside the United States — including from Mexico or the United Kingdom — you do so at your own initiative and are responsible for compliance with applicable local laws.
United Kingdom users: We are aware of your rights under UK GDPR, including the right to access, rectify, and erase personal data, as well as the right to data portability. To exercise these rights, contact us at kyle@realestatelisting.ai. The service is not subject to ICO registration at this time, but we are committed to honoring your privacy rights as described in our Privacy Policy.
Mexico users: Users in Mexico should be aware that your data is stored and processed on servers located in the United States. By using the service, you consent to this transfer.
These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or your use of ListingAI shall be resolved exclusively in the state or federal courts located in Texas. By using the service, you consent to personal jurisdiction in Texas.
For international users: this governing law clause does not override any mandatory consumer protection rights you may have under the law of your country of residence.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. For material changes, we will notify you by email. Your continued use of the service after changes are posted constitutes your acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ListingAI regarding the service and supersede all prior agreements or understandings.
